What is understood by Mining Activities?

The definition of ¨Open-pit or underground extractive industries, like all industries that carry out any of the following activities:

  • The actual extraction of mineral substances in the open air or underground, even by dredging.

  • Prospecting with a view to said extraction.

  • Preparation for the sale of the extracted materials, excluding the transformation activities of said substances.

  • Drilling or excavating tunnels or galleries, whatever their purpose, without prejudice to the provisions of the regulations on minimum health and safety conditions in construction sites.

It is established by Royal Decree 1389/1997 , of September 5, which approves the minimum provisions aimed at protecting the safety and health of workers in mining activities, which specifies what was established in the Mining Law. , Law 22/1973 , of July 21 and its General Regulations for the Mining Regime, Royal Decree 2857/197 8, of August 25.

For its part, the General Regulation of Basic Mining Safety Standards, Royal Decree 863/1985 , in its article 1, established its scope of application in: mines, quarries, maritime salt flats, groundwater, geothermal resources, natural or artificial underground deposits, drilling, open-air or underground excavations, provided that in any of the aforementioned works the application of mining techniques or the use of explosives is required, and establishments for the benefit of geological resources in general, in which mining techniques are applied.

On the other hand, the extractive industries by drilling are regulated by Article 109 of the General Regulation of Basic Mining Safety Standards, Royal Decree 863/1985 , of April 2, modified by Royal Decree 150/1996 , of February 2 .

Who should be trained?

Complementary Technical Instruction 02.1.02 regulates the minimum professional training in occupational health and safety that all workers who carry out their usual work in work centers assigned to mining activities must have.

It is applied in the work centers belonging to any of the activities that are referred to in article 1 of the General Regulation of Basic Mining Safety Standards, Royal Decree 863/1985 and in those included in paragraph a) of article 2 of Royal Decree 1389/1997 , of September 5, which approves the minimum provisions aimed at protecting the safety and health of workers in mining activities.

Article 5 defines the different training itineraries, establishing 5 different groups, within each group the different jobs that can be found, indicating that those with similar functions are grouped together. The groups are:

5.2 Outdoor activities.

5.3 Indoor activities.

5.4 Benefit establishments.

5.5 Common posts.

For its part, the Explosives Regulation through the  Royal Decree 130/2017, regulates the conditions and requirements for obtaining the gunner's card in the complementary Technical Instruction 8 . With it, the specific qualification is developed that certifies the technical and labor capacity of the workers who handle, manipulate and use explosives, establishing the basic gunner card, the specific gunner card and the gunner assistant card.

What content should the training have?

The content of the training, for all mining workers , is defined in article 6 of the ITC, Complementary technical instruction 02.1.02:

  1. Definition of jobs.

  2. Specific preventive and protection techniques.

  3. Auxiliary equipment, tools or means.

  4. Control and surveillance of the workplace and its surroundings.

  5. Interference with other activities.

  6. Regulations and legislation.

Subsequently, various TECHNICAL SPECIFICATIONS have been specifying these contents, for the different training itineraries:  

The content of the training that gunners and gunner assistants must receive are listed in the Complementary Technical Instruction 8, of the explosives regulation,  Royal Decree 130/2017.

Who should provide the training?

The characteristics of the center that must provide training for mining workers is defined in article 8 of the ITC, Complementary technical instruction 02.1.02:  

  1. Include any member who is accredited for the performance of higher level functions in Occupational Risk Prevention, in accordance with the provisions of article 37 and annex VI of Royal Decree 39/1997, of January 17, which is approves the Regulation of Prevention Services, which will perform the functions of coordinator.

  2. Its members must have specific academic or professional training in mining matters.

  3. Have work experience in the activity sector.

At TECMINA our training team meets these minimum requirements: We are a Master's Degree in PRL; We are Engineers and Graduates in Mines; and we have more than 30 years of experience in the sector.

Regarding the characteristics of the center to impart the training of gunners and gunners assistants, it is regulated by theLa Technical Specification 8.01, of the explosives regulation,  Royal Decree 130/2017.

In addition to complying with the requirements established in this standard, the supplying entities must be authorized by the General Directorate of Energy Policy and Mines.
